Guest Author Agreement

§ 1 Representations and warranties
- The author certifies that he/she is authorized by his/her co-authors to enter into these arrangements. The manuscript has been approved by all authors
- The author warrants, on behalf of himself/herself and his/her co-authors, that:
- the article is original and has neither been published nor is under consideration by any other journal
OR
the article has been accurately translated from an original publication, Copyright release documentation is enclosed. - the article does not infringe any existing copyright or any other third party rights
- the author is/the authors are the sole author(s) of the article and have full authority to enter into this agreement and in granting rights to Trier University are not in breach of any other obligation
- the author has/the authors have obtained written permission from copyright owners for any copyrighted materials (e.g. photographs or other illustrations) that are included and have credited the sources in the article
- the article contains nothing that is unlawful, libelous, or which would, if published, constitute a breach of contract or of confidence or of commitment given to secrecy
- the article corresponds to the general principles of good scientific work (according to the "Guidelines for Safeguarding Good Scientific Practice" of the DFG)
- the article is original and has neither been published nor is under consideration by any other journal
- If any claims for damages, costs, and expenses are asserted against Trier University and/or the editors-in-chief by third parties asserting that these third parties are the owner of any rights regarding the article, the author shall indemnify Trier University and the editors-in-chief (provision in favour of a third party, enforceable by virtue of sec. 328 (1) BGB) from these third-party claims, including Trier University’s and the editors-in-chief’s reasonable costs of its legal defence, and offer Trier University and the editors-in-chief the necessary assistance in its legal defence.
- The author’s obligation to indemnify Trier University and the editors-in-chief pursuant to sec. 1 (3) shall be limited to cases of negligence or intent, and shall not include loss of profit or consequential damages.
§ 2 Copyright
- The author and all co-authors retain copyright and grant Trier University right of first publication with the article licensed under a Creative Commons Attribution 4.0 International License that allows others to share the article with an acknowledgement of the article’s authorship and an obligatory mention of its first publication in IZfK.
- Trier University may enter into suitable arrangements to ensure the digital preservation of the article. The author and all co-authors agree that the archiving institution is allowed to share this article under a Creative Commons Attribution 4.0 International License and to modify the material if necessary (e.g. migrate it to a different data format).
§ 3 Place of jurisdiction and applicable law
- Trier, Germany, shall be the place of jurisdiction for all legal disputes arising of this license agreement, provided the corresponding author has no ordinary residence in the Federal Republic of Germany
- German law shall apply exclusively to all legal disputes arising from this license agreement
